Brian Picarello’s journey from social work to law has been fueled by an unwavering commitment to serving communities throughout Nassau and Suffolk Counties.

Before stepping into the legal arena, Brian delved into the realms of psychology and social work, earning his undergraduate degree from the esteemed New York University. He embarked on a mission to be a compassionate advocate for individuals from all walks of life, embracing and supporting those with unique cultural backgrounds and varied socio-economic circumstances. Among his clients were children, youthful offenders, HIV-positive individuals, low-income families, homeless individuals, and domestic violence survivors.

While juggling the responsibilities of a full-time job and providing for his family, Brian’s determination to expand his ability to make a difference led him to pursue a Juris Doctorate from Touro Law School. His dedication and intellect shone brightly as he graduated with multiple honors and awards, a testament to his relentless pursuit of excellence.

Today, as a licensed attorney practicing law in New York, Brian firmly believes that whatever his clients are facing at that time, it is likely the most important thing in their lives. This profound understanding drives his commitment to providing personalized attention to each individual he represents, ensuring they feel heard, valued, and supported throughout their legal journey.

Appellate Decisions

Coward v Biddle, 210 A.D.3d 1083 (2nd Dept 2022)
Mr. Picarello argued that the father substantiated the mother's contempt through compelling evidence, emphasizing the Family Court's authority to grant attorneys' fees due to the mother's frivolous conduct. The court dismissed the mother's plea of inability to adhere to the orders, observing her apparent substantial financial support from family members and her fiancé.
Montebello v Montebello, 2020 NY Slip Op 3109 (2nd Dept 2020)
A mother appealed a family court order granting the father sole custody of the child. Mr. Picarello successfully argued that father was the more suitable custodial parent and that there was a sound and substantial basis for the lower court to award sole custody to the father.
Kudla v. Kudla, 173 A.D.3d 1149 (2nd Dept 2019)
The former husband was held in civil contempt due to failure to pay maintenance following the terms of the divorce agreement. Mr. Picarello successfully argued that the award of lifetime maintenance to the disabled ex-wife was just, and defeated the former husband's cross-motion seeking a substantial credit towards same.
Pitkanen v. Huscher, 167 A.D.3d 901 (2nd Dept 2018)
A father appealed a family court ruling granting the mother sole legal and residential custody of the child. Mr. Picarello argued that the lower court was correct, and the Appellate Division affirmed.
